In any business a time will come when some form of dispute, complaint, problem or issue arises, most of these can and will be dealt with locally.
However it is important that all organisations have an effective Dispute Management Policy and maintain good record keeping.

Dispute Management
Dispute Management can be a complex topic and the subject range is endless. Bespoke tailored polices and procedural documentation can be prepared to assist organisations fulfil requirements and responsibilities, especially those forming part of a compliance policy or linked to an external body such as the FSA, these records would also then be available in the event of any Litigation.
Should a dispute or problem be reaching a critical point it may well be appropriate to carry out an independent assessment of records and correspondence, including a Contractual Documentation Review.

Alternative Dispute Resolution (ADR) courts are increasingly asking if the parties have considered or tried to resolve a dispute via ADR and may instruct the use of ADR in some situations.

Contractual Health Checks
Contract Health Checks. In the event that some service requirements are sub contracted to other organisations it is important that a health check is carried out to ensure that both parties are getting a fair return. It may well be that the service offer provided is extemporary but it should still be cost effective. The technological advances being made every day only serve to show that what was efficient yesterday has been superseded today with an alternative that could impact practically and financially. Organisations supplying soft services, e.g. Catering, Cleaning, Reception, Housekeeping to list just a few, should be reviewed regularly and the use of an independent consultant to assist in this process or help in the preparation and evaluation of a tender or re-bid may well be of some benefit.
